By accessing or using FiregroundOS ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a fire department or other organization, you represent that you have authority to bind that organization to these terms.
FiregroundOS is currently operated as an unincorporated business. These terms will be updated when a formal legal entity is established.
FiregroundOS provides software tools for fire department incident command, including tactical board management, crew accountability tracking, radio log recording, and AI-assisted voice input processing. The Service is provided on a subscription basis (or free during a trial or beta period, as communicated separately).
The Service is intended for use by fire department personnel and administrators. You must be at least 18 years old to create an account. Accounts are issued on a per-department basis.
You agree to use the Service only for lawful purposes related to fire department operations. You may not:
The accuracy of AI-processed voice input depends on audio quality and network connectivity. Radio transcripts should be verified against actual radio traffic. We are not liable for errors in AI-generated content.
You retain ownership of all incident data, department data, and content you enter into the Service. By using the Service, you grant FiregroundOS a limited license to store, process, and display that data solely for the purpose of providing the Service to you.
We do not claim ownership of your data. See our Privacy Policy for details on how data is handled.
Voice input, radio transcript parsing, and document scanning features are powered by Anthropic's Claude API. By using these features you acknowledge that relevant text and image data is transmitted to Anthropic's servers for processing. This data is governed by Anthropic's usage policies in addition to ours.
We aim to keep the Service available at all times but cannot guarantee uninterrupted access. The Service depends on third-party infrastructure (Base44, Cloudflare, Anthropic) which may experience outages. We are not liable for downtime caused by factors outside our control.
The Service includes limited offline capability for active incidents. See our documentation for details on what functions are available without internet access.
We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or fail to pay applicable subscription fees after reasonable notice. You may cancel your account at any time by contacting us.
Upon termination, you may request an export of your incident data within 30 days. After that period, we may delete your data.
If the Service requires payment, pricing and billing terms will be communicated separately before any charges are applied. We will provide at least 30 days notice of any pricing changes. Refund requests are handled on a case-by-case basis — contact us at mplandry77@gmail.com.
To the maximum extent permitted by applicable law, FiregroundOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated content will be accurate or complete.
We may update these terms as the Service evolves. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Massachusetts.
